We have extensive experience sponsoring family for immigration, whether the family member is a spouse, common law partner, conjugal partner, parent, grandparent, child, orphaned relative or only remaining relative.
A spousal relationship involves a marriage either in Canada or abroad.
There are two ways to sponsor your spouse or common law partner: from within Canada (inland) or through a visa office (outland).
Every year, Canadian citizens and Permanent Residents may attempt to sponsor their parents and grandparents. There is always more demand than supply and the government has adopted various mechanisms over the years from first-in-line at the processing center, to a lottery to a race to apply by entering a profile via computer.
Children under 22 years old may be sponsored provided they are not married or in a common law relationship.
We have assisted with tragic cases before where siblings, nephews, nieces or grandchildren who are not married or in a common law relationship and are under 18 have become orphans. It may be possible to ask for humanitarian and compassionate relief where an older fellow orphaned sibling is over 18 years old and we have successfully assisted in such cases.
We have extensive experience preparing clients for interviews and representing people with appeals to the Immigration and Refugee Board (IRB) and with Judicial Reviews at the Federal Court of Canada. We will need to assess if we must appeal first at the IRB or if we need to appeal directly to the Federal Court. Sometimes, the IRB will refuse jurisdiction altogether and we can advise when it’s best to re-apply to sponsor as opposed to litigating.

Unlike other countries, such as the United States, there is no income requirement to sponsor a spouse or common law partner. However, an officer can always refuse not the sponsor but the applicant if the officer feels the applicant cannot support himself or herself in Canada. For parents and grandparent sponsorships, there are income requirements.
Processing time vary but typically it’s about a year.
